1. Greek Organization Disciplinary Regulations

 

Cumberland University respects that fraternities and sororities are self-governing, legal entities responsible and liable for their own actions and the University seeks to enable and encourage Greek organizations rather than dominate or control them. However as with all student organizations, the University is responsible for insuring the safety of all students and if self-regulation does not function to produce a quality result with regards to University policies and in instances of blatant disregard for University policy, the following sanctions may be placed upon individuals (if they are personally found liable) or the fraternity/sorority as a whole.

 

Such actions can be, but are not limited to the following:

Suspension of recruitment

Recommendation to international or national office for officers’ removal from office

Notification of the international or national office of violation(s)

Planning/coordinating educational workshop or seminar for all students

Recommend expulsion from the fraternity/sorority

Social probation

Mandatory Campus or Community Service

Monetary Fines

Restitution to the University or the person to whom the offense was directed

Recommendation to the international or national office for the revocation of the Chapter’s charter at Cumberland University

 

When information alleging a potential violation by a Greek Organization is received by the Office of Greek Affairs or Dean of Students Office, the official Greek Organization Conduct Process will be used.

 

Step 1:Preliminary Investigation - Preliminary investigation begins to determine the accuracy of information and if a violation of the Code of Conduct is present. If there is not enough evidence to support the allegations of misconduct or Greek Affairs determines that the conduct does not constitute a violation of the Standards of Conduct, no charges are issued and the case is closed.

Stage 2: Written Notice & Educational Meeting - Once it is determined that there is a potential violation of the Standards of Conduct and there is at least some information to support the allegation, the Student Representative is provided written notice of an Educational Meeting by Greek Affairs. An educational conference is scheduled for the Student Representative and an Administrative Liaison (AL) to discuss the information received by Greek Affairs. In the Educational Meeting, Greek Affairs will orally inform the Student Representative of the organization about the allegations and provides the Student Representative with an opportunity to respond to the allegations, present information to Greek Affairs concerning the allegations. Based on information provided during the Educational Conference, Greek Affairs may issue a no-action determination or continue its investigation in order to determine whether it is more likely than not that the Greek Organization violated the Standards of Conduct.

Stage 3: Investigation

Stage 4: Notice of Allegations & Sanction Recommendations - If there is sufficient evidence to support the alleged misconduct, Notice of Allegations are issued to the student organization. After Notice of Allegations have been reviewed and signed by organization Student Representative, Greek Affairs will share the sanction recommendations. Greek Affairs can recommend any sanction deemed appropriate for the organization, up to revocation/ suspension of University registration.

Stage 5: Resolution - At any time during the student conduct process, a student organization may resolve allegations of misconduct by the Student Representative signing a Resolution Agreement on behalf of the organization. By signing a Resolution Agreement, the student organization: (1) accepts responsibility for violating the Standards of Conduct, as alleged by Greek Affairs; (2) agrees to the imposition of the sanction(s) proposed by Greek Affairs; and (3) waives all rights the student organization may have to resolve the allegations through a Formal Hearing.

 

At any time during the student conduct process, Greek Affairs may propose an alternative resolution processes such as mediation, facilitated dialogue, conflict coaching, and/ or restorative justice. An Alternative Resolution Agreement is then drafted and signed by both parties.

 

If the organization does not accept responsibility and/ or the sanctions, the Student Representative may elect to have their student organization’s case heard through a Formal Hearing.
